Regulations of the Program of cooperation with photographers
§1 General Provisions
These Regulations set forth the rules of participation in the “Program of cooperation with photographers” (hereinafter referred to as the “Program”) conducted by Framky.
Only a Photographer conducting photographic business may register in the Program.
Photographer can register only once.
Participation in the Program is voluntary and free of charge.
§2 Registration in the Program
To participate in the Program, a Photographer must register by creating an account for the Photographer’s Panel.
Framky reserves the right to refuse registration in the Program if a person does not meet the requirements for participation in the Program.
After registering in the Program, Framky grants the Photographer a voucher worth EUR 50, which can be used to order a test gallery to evaluate the quality of Framky products.
§3 Photographer’s Panel
In the Photographer’s Panel the Photographer can:
add new assignments by entering client data and uploading photos from the photo session,
choose to divide the 20% discount from Framky between the commission for himself and the discount for the client,
monitor the status of each order,
check the commission balance and detailed commission register.
§4 Order process
After a Photographer adds an order and uploads photos, the Photographer will receive a link to Framky Studio.
The photographer can pass this link to the client. The link is secured with a unique token so that an unauthorized person cannot access the uploaded photos.
Framky sends the client an email on behalf of the photographer with a reminder to access the photos in Framky Studio. If necessary, Framky will send additional reminders at intervals of several days.
If a customer places an order, the photographer will receive a commission in the value set when the order is added.
§5 Payment of commissions
The payment of commissions by Framky is made on the basis of an invoice issued by the photographer. The invoice due date should be at least 30 days.
The photographer can issue an invoice not more often than once a month.
Each payment is recorded in the commission register.
§6 Photographers’ business cards on the Framky website.
A photographer may choose to place his/her business card on the Framky website in the “Professional Sessions” section.
Business cards may include information such as the photographer’s name, a brief description, contact information, portfolio photos and links to social media profiles.
A photographer who wants to publish a business card must add information about cooperation with Framky in the form of a graphic badge with a link to Framky’s website (dofollow link) on his page.
The business card is published after Framky verifies the link on the photographer’s site.
§7 Data change and resignation
The photographer may change his/her personal data and contact information in the Photographer Panel at any time.
The Photographer cannot change the commission rate after the link for the client gets created.
Framky is not responsible for any problems arising from incorrect data provided by the Photographer.
The Photographer may resign from participation in the Program at any time by notifying Framky in writing or by email.
Framky may terminate the contract without cause. In the event of termination, the Photographer shall be entitled to accrued commissions.
§8 Protection of the Photographer’s personal data
The administrator of the personal data of the Photographer and its orders is Framky sp. z o.o. with registered office: Heliotropów 29 04-796 Warsaw, Poland.
The personal data are processed in accordance with the applicable personal data protection regulations and Framky’s privacy policy.
§9 Protection of clients’ personal data
The administrator of clients’ personal data is the Photographer.
The Photographer declares that the processing of clients’ personal data and the placement of photographs with their image in Framky does not violate the rights of third parties and generally applicable laws.
The Photographer entrusts the processing of this data to Framky for storing the photos and sending access information to the gallery to customers.
Photographer’s customers’ personal data are processed in accordance with the applicable data protection regulations and Framky’s privacy policy.
The Photographer declares that he has read and accepts the provisions of Framky’s Privacy Policy.
§10 Final provisions
These Regulations are available on the Framky website and in the Photographer’s Panel.
Framky reserves the right to change the Regulations at any time. Changes to the Regulations will be communicated to the Photographer in an appropriate manner, e.g. by e-mail.
If the Regulations are changed, the Photographer has the right to resign from the Program without having to provide a reason, by informing Framky in writing or by e-mail.
Any disputes arising from participation in the Program will be resolved by the competent common court, in accordance with the laws of the place of Framky’s headquarters.
