Parties. Framky sp. z o.o., Heliotropów 29, 04-796 Warsaw, Poland, NIP 5213928409 ("Framky"), and the person who registers for Framky Artists on the Framky website ("Photographer").
This Agreement covers the photos that the Photographer uploads, or imports (for example from Unsplash), in the Framky Artists panel ("Photos"). The Photographer chooses which photos to add and can remove them at any time.
The Photographer grants Framky a non-exclusive, worldwide licence to:
Framky will not:
Framky may crop the Photos to frame proportions, resize them and apply standard colour management for printing. Framky will not apply creative filters (such as black and white) without the Photographer's consent.
Framky will credit the Photographer by name, with a link to the profile the Photographer chooses (for example a website or social profile), shown next to the Photos in Framky's photo browser and gallery editor. The Photographer can change the display name and links in the panel at any time.
At this stage the programme offers credit with a link and simple statistics in the panel (how many times the Photos were added to frames, how many frames were ordered, and in which countries). The programme does not include revenue share or other payments. If this changes, Framky will inform the Photographer, and any change will apply only if the Photographer accepts it.
Every photo is reviewed automatically, for example for resolution and quality, identifiable people, logos and trademarks, watermarks and inappropriate content. Framky may reject a photo, or hold it for manual review, and the Photographer can ask for a photo to be reviewed again. A rejected photo is not offered to customers.
The Photographer confirms that:
Framky processes the Photographer's name, email address, country and profile links only to perform this Agreement (Art. 6(1)(b) GDPR). The credit is public, because it is the essence of the Agreement. Framky never shares its customers' personal data with the Photographer, only aggregated statistics. Framky deletes the Photographer's data after the Agreement ends, except where the law requires otherwise.
