Framky Artists: Photographer Agreement

Parties. Framky sp. z o.o., Heliotropów 29, 04-796 Warsaw, Poland, NIP 5213928409 ("Framky"), and the person who registers for Framky Artists on the Framky website ("Photographer").

1. Photos

This Agreement covers the photos that the Photographer uploads, or imports (for example from Unsplash), in the Framky Artists panel ("Photos"). The Photographer chooses which photos to add and can remove them at any time.

2. What Framky may do

The Photographer grants Framky a non-exclusive, worldwide licence to:

  • print the Photos and sell them only as physical framed prints made and sold by Framky, individually or in gallery wall sets;
  • show low-resolution previews and wall mock-ups of the Photos on Framky's websites and apps, and let customers who do not have their own photos choose them in the configurator;
  • use those previews to promote Framky products on social media, newsletters and ads, always with credit.

3. What Framky will not do

Framky will not:

  • sell, license or give away digital files, or offer downloads of the Photos;
  • use the Photos on any product other than framed prints;
  • use the Photos to train AI models;
  • sublicense the Photos, except to technical service providers acting on Framky's behalf (for example hosting or printing).

Framky may crop the Photos to frame proportions, resize them and apply standard colour management for printing. Framky will not apply creative filters (such as black and white) without the Photographer's consent.

4. Credit

Framky will credit the Photographer by name, with a link to the profile the Photographer chooses (for example a website or social profile), shown next to the Photos in Framky's photo browser and gallery editor. The Photographer can change the display name and links in the panel at any time.

5. Rewards

At this stage the programme offers credit with a link and simple statistics in the panel (how many times the Photos were added to frames, how many frames were ordered, and in which countries). The programme does not include revenue share or other payments. If this changes, Framky will inform the Photographer, and any change will apply only if the Photographer accepts it.

6. Automated review of photos

Every photo is reviewed automatically, for example for resolution and quality, identifiable people, logos and trademarks, watermarks and inappropriate content. Framky may reject a photo, or hold it for manual review, and the Photographer can ask for a photo to be reviewed again. A rejected photo is not offered to customers.

7. Withdrawal and termination

  • The Photographer may withdraw any or all Photos, or end this Agreement, at any time, without giving a reason, in the panel or by email.
  • Framky will remove withdrawn Photos from its catalogue and pages within 7 days.
  • Orders paid before removal (including their reprints or complaint replacements) will still be fulfilled.
  • Marketing posts published before withdrawal may remain online.
  • Framky may end this Agreement or pause the Photographer's account by email on the same terms, including when the Photographer's Photos or conduct breach this Agreement.

8. Photographer's warranties

The Photographer confirms that:

  • they took the Photos and own all rights needed for this Agreement;
  • the Photos show no identifiable people and no prominent logos or trademarks;
  • the Photos are not watermarked, are not AI-generated and are not screenshots;
  • they have not granted anyone exclusive print rights to the Photos, and the Photos do not infringe the rights of third parties.

9. Personal data

Framky processes the Photographer's name, email address, country and profile links only to perform this Agreement (Art. 6(1)(b) GDPR). The credit is public, because it is the essence of the Agreement. Framky never shares its customers' personal data with the Photographer, only aggregated statistics. Framky deletes the Photographer's data after the Agreement ends, except where the law requires otherwise.

10. General

  • This Agreement is governed by Polish law, and disputes are resolved by the court competent for Framky's registered office.
  • The Photographer accepts this Agreement electronically, by ticking the acceptance checkbox in the Framky Artists registration form. Framky records the version of the terms, the time of acceptance and technical data related to it.
  • Framky may update these terms. A new version applies to the Photographer only after the Photographer accepts it.
