The administrator of the personal data is Framky LTD with its registered office in Warsaw (04-796), at Heliotropów 29 Street, entered in the Polish Register of Entrepreneurs under KRS number 0000899512.

Purposes of personal data processing

Framky sp. z o. o. will process your personal data for the following purposes:

  • Providing services related to the company’s business profile,
  • Implementation of concluded contracts and placed orders,
  • Providing materials and information to promote services (marketing purposes),
  • Establishing marketing cooperation,
  • Handling any complaints,
  • analytical and statistical purposes.

Legal grounds for processing personal data

Framky processes your personal data on the basis of:

  • the consent of the person whose personal data is being processed, given at the time of the transfer of personal data, or
  • in connection with the execution of the agreement between Framky and the person whose personal data is being processed, or
  • legitimate interest pursued by the administrator, or
  • other laws.

  • entities that process personal data on behalf of Framky,

Framky Website

Framky may automatically collect and record certain data regarding your activity on framky.com (also framky.de, framky.pl) including browser type, IP address, etc. The data is used solely for analytical and statistical purposes.

The Framky website uses cookies, which can be used to identify a user’s session when using the website. Cookies do not contain any personal data.

In order to block the transmission of cookies, you must configure the settings of the Internet browser you are using accordingly.

How and why do we process your personal data?

PROCESSING OF DATA PRIOR TO PURCHASE
  1. Purpose: To save the contents of your cart that have not been purchased, and to remind you of a product left in your cart if you have left us an email address.

    What personal data we process: the e-mail address you provide, as well as information about the products you have selected and your favorite compositions of your photos.

    Legal basis: Our legitimate interest in providing you with the easiest way to purchase the products you were interested in by placing them in your shopping cart.

    How long we process your personal data for these purposes: From the time you provide us with your email until the time of purchase, or no longer than 60 days.
  2. Purpose: To answer your concerns and questions.

    What personal information we process: Your contact information, name, email address, phone number, photos you send to us and other information you give us.

    Legal basis: Processing is necessary for the performance of the contract concluded with you.

    How long we process your personal data for these purposes: For three years or as long as required by law.
DATA PROCESSING REQUIRED FOR CONTRACT AND PURCHASE

We need to process your personal data so that we can save your photos and receive feedback from you. If you do not provide us with personal information for this purpose, we will not be able to provide you with services or respond to your inquiries. We also need your personal information to fulfill your orders, for example, to deliver products to you. We also need to process your personal data to comply with legal and other requirements, such as the requirement to retain data under consumer protection or accounting laws. If you do not provide us with your personal information for these purposes, we will not be able to process your order.

Our payment service providers also process personal data to process your payment for your order. Companies providing payment services to us are independently responsible for such data processing.

  1. Purpose: To save your photos for print and receive feedback from you.

    What personal data we process: Your name, contact information, for example, your email address, delivery address, information about your order and selected payment method, and IP address.

    Legal basis: Processing is necessary for the performance of the contract concluded with you.

    How long we process your personal data for these purposes: As long as required by law.
  3. Purpose: to enable you to exercise your right to withdraw a product and so that we can comply with consumer protection laws.

    What personal information we process: Your name, phone number, email address, mailing address and information about your purchase, such as your payment method.We also record the information you provide to us when you exercise your right of withdrawal.

    Legal basis: the processing is necessary for the performance of the contract concluded with you, and for the fulfillment of the return policy and the requirements of consumer protection legislation.

    How long we process your personal data for these purposes: If you choose to exercise any of your rights, we will process your personal data until we decide to withdraw or replace the product and make any payment or ship the product to you.
  4. Purpose: To handle complaints and/or legal disputes.

    What personal data we process: Your name, contact information, information you provide that is relevant in light of a complaint or legal dispute.

    Legal basis: The need to comply with the requirements of relevant consumer protection laws and in our legitimate interest in handling complaints and/or defending against claims.

    How long we process your personal data for these purposes: From the moment we become aware of your complaint and/or the commencement of a legal dispute until its conclusion. If we do not acknowledge your complaint, we keep the information related to it for twelve months, in case you decide to initiate a legal dispute before a court of competent jurisdiction.
  5. Purpose: To comply with legal obligations, e.g. under accounting or anti-money laundering laws.

    What personal data we process: Information from your invoice, for example order history, name, contract data.

    Legal basis: to meet the requirements of applicable regulations.

    How long we process your personal data for these purposes: As long as required by accounting law and anti-money laundering regulations.
  6. Purpose: If a friend refers you to us, we process your personal data in order to pay the provider of the solution that allows you to refer friends.

    What personal data we process: Your email address in the form of a coded text-ID.

    Legal basis: Our legitimate interest is for us to pay our supplier only for purchases made by new customers it refers to us.

    How long we process your personal data for these purposes: We do not retain this data.
DATA PROCESSING FOR THE PURPOSE OF OBTAINING OPINIONS
  1. Purpose: to contact you with a request for feedback.

    What personal data we process: Your email address, name, order number, contact phone.

    Legal basis: Requirement arising from the processing of your personal data so that we may contact you with a request for an evaluation or feedback on the service in our store, and so that we may improve the quality of our service.

    How long we process your personal data for these purposes: Until we contact you.
DATA PROCESSING FOR CUSTOMER ACCOUNT MANAGEMENT

In order to manage your customer account, we process your personal data for the performance of the contract concluded with you. Without personal information, we cannot provide you with a customer account.

  1. Purpose: To manage the customer account you have created – the saved compositions of your photos. Its scope is, for example, to send you up-to-date information about your account and our privacy policy, and to process your data in order to apply security measures to your account.

    What personal data we process: Your name, personal identification number, email address, cell phone number, cookies, IP address, user name and the goods delivery address you provided.

    Legal basis: Implementation of the agreement to provide you with an account. Processing your data to send you updates to the privacy policy is necessary to comply with data protection laws.

    How long do we process your personal information for these purposes: from the time you make a purchase, for two (2) years from the time you last logged in, or until you ask us to delete your account.
PROCESSING YOUR DATA TO INFORM YOU ABOUT OFFERS, NEWS AND INSPIRATION
  1. Purpose: To send newsletters, relevant offers and marketing materials.

    What personal data we process: Your e-mail address and purchase history associated with that address, e-mail interaction history ie. opens, clicks, etc., cookies and IP address.

    Legal basis: in our legitimate interest of sending direct marketing offers if you have purchased a product from our store and/or saved your compositions with your email address and have not objected to receiving marketing materials.

    How long we process your personal data for these purposes: until you opt out of receiving marketing information from us.
  2. Purpose: To carry out marketing on social media and third-party websites.

    What personal data we process: Your email address, cookies and IP address.

    Legal basis: Our legitimate interest is to use your personal data for direct marketing purposes and to tailor marketing offers to your interests. We do this if you have purchased goods from us and/or saved your compositions in Framky Studio and have not objected to receiving marketing materials.

    How long we process your personal data for these purposes: from the moment you make a purchase or save a gallery at Framky Studio, for two (2) years, unless you request us to stop sending marketing offers before then.
  3. Purpose: To publish the opinion written by you in order to provide transparency of our service to our service visitors and to offer our brand to potential customers.

    What personal information we process: Your name, email, username on Instagram and/or Google or Facebook and the information you provided in your feedback (may include your photos or videos).

    Legal basis: Our legitimate interest is to publish the opinion you have written or said on the video and make it available on our website.

    How long we process your personal data for these purposes: Until you delete your feedback.
  4. Purpose: to sell our products on our website. To fulfill it, we may publish photos/videos of the product shared by you on your social media profile tagged with #framky, #framkygallery or similar.

    What personal data we process: The photo/video you shared on social media, your username and your text. All of these items may contain your personal data.

    Legal basis: Our legitimate interest is to publish photos/videos tagged by you with the #framky, #framkygallery or similar tag.

    How long we process your personal data for these purposes: Until you declare that you no longer want us to display your photo/video on our website.

What are cookies?

A cookie is a small text file stored on your computer when you visit a website. Framky uses Cookie information to track activities performed by Users on our website, for statistical purposes, and to improve and personalize the user experience.

One way to use persistent cookies is to store a user’s personal settings on studio.framky.co.uk so that the user does not have to repeat actions such as uploading photographs on each visit to the site. Session cookies provide statistical data on website usage.
