Framky Artists terms

Version: 2026-10-15

Framky Artists: Photographer Agreement

Parties. Framky sp. z o.o., Śliska 20, 05-075 Warsaw, Poland, NIP 5213928409 ("Framky"), and the person who registers for Framky Artists on the Framky website ("Photographer").

1. Photos

This Agreement covers the photos that the Photographer uploads, or imports (for example from Unsplash), in the Framky Artists panel ("Photos"). The Photographer chooses which photos to add and can remove them at any time.

2. What Framky may do

The Photographer grants Framky a non-exclusive, worldwide licence to:

  • print the Photos and sell them only as physical framed prints made and sold by Framky, individually or in gallery wall sets;
  • show low-resolution previews and wall mock-ups of the Photos on Framky's websites and apps, and let customers who do not have their own photos choose them in the configurator;
  • use those previews to promote Framky products on social media, newsletters and ads, always with credit.

3. What Framky will not do

Framky will not:

  • sell, license or give away digital files, or offer downloads of the Photos;
  • use the Photos on any product other than framed prints;
  • use the Photos to train AI models;
  • sublicense the Photos, except to technical service providers acting on Framky's behalf (for example hosting or printing).

Framky may crop the Photos to frame proportions, resize them and apply standard colour management for printing. Framky will not apply creative filters (such as black and white) without the Photographer's consent.

4. Credit

Framky will credit the Photographer by name, with a link to the profile the Photographer chooses (for example a website or social profile), shown next to the Photos in Framky's photo browser and gallery editor. The Photographer can change the display name and links in the panel at any time.

Next to the Photos, Framky may tell customers that buying a frame with that Photo supports the Photographer, and what share of the print value the Photographer receives under section 5. The panel also shows the Photographer statistics: how many times the Photos were added to frames, how many frames were ordered, and in which countries.

5. Remuneration

  1. For every paid frame with a Photo, the Photographer receives remuneration of 10% of the print value, unless Framky and the Photographer agree a different rate. The current rate is shown in the panel.
  2. The print value is the part of the frame price that relates to the print of the Photo itself: net (excluding VAT), excluding delivery costs and after all discounts the customer used. The frame, self-adhesive hangers, passe-partout and mounting template are not part of the print value. If a customer orders several copies of the same frame, remuneration is due for each copy. Remuneration is expressed in the currency of the Photographer's account. Framky converts amounts from orders in other currencies at the exchange rate on the day the remuneration is accrued.
  3. Remuneration becomes due 45 days after the order is placed. A return of the order cancels the remuneration for that order, even if it has already been paid out; in that case the amount is deducted from the Photographer's balance. A reprint or replacement under a complaint does not give rise to additional remuneration.
  4. Payment in money is available only to a Photographer who runs a business (a company or a sole trader), on the basis of an invoice issued to Framky. The minimum payout is 50 EUR or the equivalent amount in the currency of the Photographer's account. Framky transfers the invoiced amount to the Photographer's bank account within 14 days of approving the invoice.
  5. A Photographer who is a private person receives remuneration only as a Framky voucher and cannot demand payment in money. The voucher is issued for an amount chosen by the Photographer, up to the available balance. The voucher is single-use, valid for 12 months from the date of issue and can be used only for purchases from Framky. The voucher cannot be exchanged for cash, and any unused part of its value is lost. An order paid with such a voucher does not give the Photographer a right to remuneration.
  6. The Photographer states in the panel whether they act as a business or as a private person, provides the details needed for payout and is responsible for them being true and up to date. A change of status applies from the next payout. Vouchers already issued remain valid.
  7. Framky calculates, withholds and pays tax on the remuneration only where the law requires Framky to act as a tax remitter. All other tax obligations relating to the remuneration are the Photographer's responsibility.
  8. Framky may change the remuneration rate by informing the Photographer by email at least 30 days before the change takes effect. The new rate applies only to orders paid after it takes effect.
  9. After the Photos are withdrawn or this Agreement ends, Framky settles the Photographer's balance, including remuneration for orders paid before the Photos were removed, under points 4 and 5.

6. Automated review of photos

Every photo is reviewed automatically, for example for resolution and quality, identifiable people, logos and trademarks, watermarks and inappropriate content. Framky may reject a photo, or hold it for manual review, and the Photographer can ask for a photo to be reviewed again. A rejected photo is not offered to customers.

7. Withdrawal and termination

  • The Photographer may withdraw any or all Photos, or end this Agreement, at any time, without giving a reason, in the panel or by email.
  • Framky will remove withdrawn Photos from its catalogue and pages within 7 days.
  • Orders paid before removal (including their reprints or complaint replacements) will still be fulfilled, and remuneration for them will be settled under section 5.
  • Marketing posts published before withdrawal may remain online.
  • Framky may end this Agreement or pause the Photographer's account by email on the same terms, including when the Photographer's Photos or conduct breach this Agreement.

8. Photographer's warranties

The Photographer confirms that:

  • they took the Photos and own all rights needed for this Agreement;
  • the Photos show no identifiable people and no prominent logos or trademarks;
  • the Photos are not watermarked, are not AI-generated and are not screenshots;
  • they have not granted anyone exclusive print rights to the Photos, and the Photos do not infringe the rights of third parties.

9. Personal data

Framky processes the Photographer's name, email address, country and profile links only to perform this Agreement (Art. 6(1)(b) GDPR). The credit is public, because it is the essence of the Agreement.

To accrue and pay remuneration, Framky also processes the Photographer's status (business or private person), company details (name, tax ID or EU VAT number, address), bank account number and the history of accruals, payouts, invoices and vouchers (Art. 6(1)(b) and (c) GDPR). Framky keeps the data needed for accounting and tax purposes for 5 years from the end of the tax year in which the payout was made or the voucher was issued.

Framky never shares its customers' personal data with the Photographer. In the panel the Photographer sees only aggregated statistics and the components of the remuneration calculation (for example frame size, print value, rate and amount), without customer data. After the Agreement ends, Framky deletes the Photographer's data, except data it must keep under the law.

10. General

  • This Agreement is governed by Polish law, and disputes are resolved by the court competent for Framky's registered office.
  • The Photographer accepts this Agreement electronically, by ticking the acceptance checkbox in the Framky Artists registration form. Framky records the version of the terms, the time of acceptance and technical data related to it.
  • Framky may update these terms. A new version applies to the Photographer only after the Photographer accepts it. A Photographer who registered earlier accepts the new version in the panel.
  • Remuneration under section 5 is due for orders paid on or after 15 October 2026. From that day Framky accrues it also for a Photographer who has not yet accepted this version of the terms, but a payout or voucher is possible only after the Photographer accepts it. No remuneration is due for orders paid before that day.
