Partner Program – affiliate marketing program operated by the Administrator, allowing Partners to earn commissions by promoting Framky products.
Partner – an individual or business entity that has successfully registered for and been accepted into the Partner Program.
Partner Account – a dedicated account in the Partner Panel where the Partner can track referrals, commissions, and access marketing materials.
Partner Link – a unique tracking URL assigned to each Partner for identifying referred customers.
Commission – the monetary compensation paid to Partners for successful referrals resulting in completed purchases.
Conversion Window – the 30-day period during which a referred customer's purchase will be attributed to the Partner.
Partner Panel – the online dashboard where Partners can monitor their performance, access marketing materials, and manage their account.
The Partner Program is operated by the Administrator and enables Partners to earn commissions by promoting Framky products and services.
These Terms and Conditions govern the relationship between the Administrator and Partners. By joining the Partner Program, you accept these Terms in full.
Participation in the Partner Program is free of charge. No fees are required for registration, participation, or access to marketing materials.
The Administrator reserves the right to accept or reject any application to join the Partner Program at its sole discretion.
Partners must be at least 18 years old or the age of legal majority in their jurisdiction, whichever is higher.
To join the Partner Program, applicants must complete the registration form providing accurate and complete information including:
The Administrator will review applications within 5 business days and notify applicants of acceptance or rejection via email.
Partners are responsible for maintaining accurate and up-to-date information in their Partner Account.
Partner Accounts are non-transferable and may not be sold, shared, or assigned to third parties.
Partners must protect their account credentials and immediately notify the Administrator of any unauthorized access or security breaches.
The Partner Program uses the following fixed rates:
The rates in ust. 1 apply uniformly to all Partners regardless of sales volume, product category, or promotional period, unless expressly agreed otherwise in writing between the Partner and the Administrator.
Current rates are also published in the Partner Panel. Any change to the rates set out in ust. 1 will be communicated to Partners by email at least 30 days before taking effect, in accordance with § 12.
Commissions (both the 20% Partner commission and the 2% referral commission) are calculated on the same base — the net amount actually received by the Administrator from the customer after the 25% discount and excluding VAT, shipping, and any refunds, returns, or chargebacks.
Commissions are only earned on completed purchases where:
Customer referrals are tracked using cookies and the Partner's unique tracking link.
The conversion window is 30 days from the customer's first click on the Partner Link.
If a customer clicks multiple Partner Links, the last-click attribution model applies – the Partner whose link was clicked most recently before purchase receives the commission.
The Administrator uses industry-standard tracking technology but cannot guarantee 100% tracking accuracy due to factors beyond our control (cookie blocking, technical issues, etc.).
Partners may not use methods to artificially inflate clicks or manipulate tracking, including but not limited to:
Commissions are calculated monthly and become payable after the applicable return period has expired (typically 14-30 days after purchase).
Minimum payout threshold is 50 EUR. Commissions below this threshold will carry over to the following month.
Payments are processed by the 10th day of each month for commissions earned in the previous month.
Partners must provide valid tax documentation and payment information to receive payments.

The Administrator grants Partners a limited, non-exclusive, revocable license to use Framky trademarks and marketing materials solely for promoting Framky products through the Partner Program.
This license terminates immediately upon termination of the Partner's participation in the Program.
Partners may not:
All intellectual property rights in Framky materials remain with the Administrator.
Partners must comply with all applicable data protection laws including GDPR when collecting or processing personal data in connection with the Partner Program.
Partners may not collect Framky customer data except as necessary for attribution tracking through approved methods.
Any customer data accessed through the Partner Program must be:
The Administrator's handling of Partner data is governed by our Privacy Policy.
The Partner agreement begins upon acceptance into the Program and continues indefinitely unless terminated.
Either party may terminate the agreement at any time with 30 days' written notice.
The Administrator may terminate immediately for cause including:

The Administrator provides the Partner Program "as is" without warranties of any kind, express or implied.
The Administrator is not liable for:
Partners agree to indemnify and hold harmless the Administrator from any claims, damages, or expenses arising from:
The Administrator's total liability under this agreement shall not exceed the total commissions paid to the Partner in the preceding 12 months.
The Administrator reserves the right to modify these Terms and Conditions at any time.
Partners will be notified of material changes via email at least 30 days before they take effect.
Continued participation in the Partner Program after changes take effect constitutes acceptance of the modified terms.
If a Partner disagrees with any changes, they may terminate their participation as outlined in § 10.
These Terms and Conditions constitute the entire agreement between the parties regarding the Partner Program.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
The Partner relationship does not create an employment, agency, joint venture, or franchise relationship between the parties.
Partners may not assign their rights or obligations under this agreement without the Administrator's written consent.
Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms and Conditions are governed by the laws of Poland.
Any disputes arising from or relating to the Partner Program shall be resolved through good faith negotiations.
If negotiations fail, disputes shall be submitted to the competent court in Warsaw, Poland.
Partners acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions.
This section applies to all Partners in the Program and complements §§ 1-14.
Active online presence requirement. Every Partner must maintain at least one active online presence relevant to their audience — for example a business website, a professional portfolio, an active social media profile, or any other public channel through which the Partner promotes their work. The Administrator may verify the Partner's online presence at any time, and may suspend the Partner's participation in the Program if the presence is no longer active or no longer aligns with the audience for which the Partner was accepted into the Program.
Referral link. Upon acceptance into the Program, each Partner receives a unique referral link in the form framky.com/{slug}, where {slug} is a short alphanumeric identifier between 3 and 30 characters, consisting of lowercase letters, digits, and hyphens, starting and ending with an alphanumeric character. The referral link serves as the Partner's compact tracking URL, shareable across channels. The same identifier in uppercase form is also used as the Partner's public coupon code by customers referred by the Partner.
Reserved identifiers. The Administrator maintains a list of reserved identifiers that cannot be used in a referral link, including: locale prefixes, existing site routes, Framky brand-related names, and names that in the Administrator's judgment would mislead customers or conflict with third-party rights. The Administrator may reject any referral link request at its sole discretion and may reclaim a previously assigned referral link if it is later found to conflict with these rules.
Personal coupon for Partner's own orders. In addition to the public coupon code, each Partner receives a personal coupon code reserved exclusively for the Partner's own orders — for example samples for the Partner's studio or office, gifts, or personal use. Orders paid with the personal coupon do not earn commission, because such orders do not represent referrals of third-party customers.
Prohibited self-attribution. Partners must not use the public coupon code or their own referral link for their own orders. The personal coupon exists for that purpose. The Administrator monitors orders for signs of self-attribution, including matching email addresses, shipping addresses, and IP addresses between the Partner's account and the referred customer. Orders identified as self-attributed may have their commission reversed and, in cases of repeated or egregious misuse, may result in suspension or termination of the Partner's participation in the Program.
Referral link transferability. Partner referral links are non-transferable. A referral link remains associated with the Partner who selected it for as long as the Partner remains active in the Program. Upon termination of the Partner agreement, the Administrator may retire the referral link or, after a reasonable period, reassign it to another Partner.
This section governs the referral commission introduced in § 4 ust. 1 and applies to all Partners in the Program.
Refer other Partners and earn on their sales too. As a Partner, you may invite photographers and other businesses to join the Program through your own affiliate link (the "Referring Partner"). Anyone who joins the Program through that link (the "Referred Partner") runs their own business on the same terms as any other Partner — and you earn an additional referral commission on their qualifying sales to end customers. The structure is as follows: Referring Partner → Referred Partner → Customer. Referral commission always goes to the Partner who directly invited a given Referred Partner — and once a Referred Partner begins inviting others themselves, the referral commission on those new Partners' sales belongs to them.
Rate. Referral commission is 2% of the net amount paid by the customer — calculated on the same base as the Referred Partner's 20% Partner commission — for every qualifying order attributed to the Referred Partner's affiliate link or public coupon code, for as long as the Referred Partner remains active in the Program.
Paid from the Administrator's margin. Referral commission is paid by the Administrator from its own margin. It does not reduce the 20% commission earned by the Referred Partner on their own sales, and it does not reduce the 25% discount granted to the customer.
Attribution and payment. Referral commission is subject to the same 30-day conversion window (§ 5), return-period lock-in, refund reversal rules, minimum payout threshold (§ 6 ust. 2), and monthly payment cycle (§ 6 ust. 3) as standard Partner commission.
Invoicing. Where the Referring Partner is a business entity, referral commission is documented on the Referring Partner's commission invoice issued to the Administrator under the same rules as standard Partner commission. The 2% is the gross amount on the commission invoice; any applicable VAT is added on top of the 2% by the Referring Partner in accordance with the Partner's tax status.
Anti-fraud. The following practices are prohibited and will result in reversal of affected referral commission and, in cases of repeated or egregious misuse, suspension or termination of participation in the Program:
The Administrator reserves the right to audit referral chains at any time and to require documentation proving independent operation of the Referring and Referred Partners.
Termination effect. If the Referred Partner's participation in the Program is terminated for any reason (§ 10), the Referring Partner's right to referral commission on that Referred Partner's future sales terminates automatically on the same date. Referral commission already accrued for qualifying orders completed before termination will be paid according to the standard payment terms (§ 6).
Changes to the referral rate. The 2% referral rate set out in § 4 ust. 1 and this § 16 may be changed by the Administrator only in accordance with § 12 (at least 30 days' notice by email to all Partners).
